    Default Support Overpayment Due to a Court Error

    My question involves child support in the State of: Florida
    I had been paying child support to my ex husband for my daughter who lived with me for 2 years and had been battling the state to get the child support modified. I had brought the arrearages down to $180.00, however, my ex had previously filed paperwork stating that I was $1000 behind. At the time that the judge signed for a $1000 purge payment, as I stated, the balance remaining was only $180. In order to prevent myself from losing my job, I had to pay the $1000. How can I go about getting this refund from the state for the judges error.

    If in fact you have now overpaid by $820, then you should have a $820 credit balance with Child Support Enforcement. Do they confirm that to be the case? If you request that the credit be applied prior to the end of your support obligation, states typically do so in installments, reducing the overall child support payment for some period of months so as to ensure that it's not the children who end up suffering.
