    Default How Much Income Does a Spouse Have to Earn Before Paying Alimony

    My question involves a marriage in the state of: Florida.
    I have severe Rhuematoid Arthritis and am disabled but dont qualitfy for disability, because of our income and am not able to work. Our source of income is from my spouse which is retired and recieves SS and pension fund (pretty decent). We have no assets, property or children together. We have been married for 12 years and together for 19. He indicates that I am not entitled to anything because it is his money. Is this true?

    You can explore your qualification for Social Security retirement benefits, assuming you're old enough to qualify, based on your marriage (and your own work record, if applicable).

    If you were married prior to your husband's retirement, you would have a claim against your husband's retirement benefits relating to those years of marriage. Division of pension benefits can get complicated once they are in pay status, so that's something to discuss with a lawyer.

    Spousal support is always payable out of one spouse's income/assets, so I'm not sure what he thinks saying "It's my money" signifies.
