    Default Denial of Use of a Facility to a Gay Couple

    My question involves civil rights in the State of: NY

    A local business that is open for public functions such as weddings, corporate parties and such has denied the use of their venue to a gay couple in which to hold their wedding reception. The couple sued and has stirred some moderate media coverage with much speculation. Curious as to opinions on who will be the likely winners.

    Well it would depend on WHERE in NY and whether they are suing in state or federal court. While I don't think this has been strongly decided yet in the second circuit, I'd give them a pretty strong chance in the second circuit. Otherwise, outside NYC, I give them about 70-30.

    The legal venue is in rural upstate NY.

    The immediate area is rural, however the capital region is significantly different than western NY politically.

    Is there a link to the story? The big question might be WHY was reception/event denied?

    I suspect it will be yet another "religious freedom" type of argument.

    It doesn't appear to have been decided yet (at least, I can't find any more recent news). As to who will win, I don't know ... I sympathize with the farm owners, however, and can understand their reticence in accepting the use of their property for an event they feel is contrary to their religious beliefs.

    To some, the denial is sufficient enough to claim injury and sue.
