    Default Possibility of a Lawsuit Over Battery Committed as a Minor

    Hello I am from Wisconsin,

    Over 3 years on 8/3/03 ago when I was 16 years old, and 3 days away from turning 17, I got into a fight with a kid that was 17 years old, his birth day is 1/25/86. He went to the hospital and totaled a bill of $ 2,108.71
    After almost three years went by I finaly went to court. I got defered entry of judgment, so I have to be good for 2.5 years and it won't be on my record, and I was ordered to pay that amount above, which a have.
    About a year ago from todays date he has got into trouble for tossing a bike off a bridge at a car doing like 60 mph, he hospitalized these people in the vehicle. He got 2 felony counts of reclessly endangering saftey, but when the police questioned him for the crime he told them it was me that did it, in effort to frame him, because I have a criminal case pending for a that fight we got in.
    My question is can he and his parents sue me and my parents for this?
    The statue of limitations say that after two years after the victim turns 18 he can no longer sue me. Yet they are still trying, and my lawyer said he can't. But his lawyers brought up some legal loophole saying something about if the restituion is not paid thay can ask for more. so I just paid it off today, and we have not went to court for this cival suit yet.
    Also, how can he sue me and my parents, if I wasn't yet legaly responsible for myself at the time of the incident, how can he get money out of me, my lawyer says that because they waited till I was at least 18 to file the suit they can sue me, because I am now legaly reposible for myself, well then if I am legaly responsible for myself, how can he be sueing my parents too?!!. PLEASE SOMEBODY GIVE ME YOUR OPINION ON THIS!!

    You committed a battery. Your being 16 at the time isn't relevant to whether or not you can be sued for your intentional wrongful (criminal) conduct.

    If they have missed the statute of limitations, then on your lawyer's motion any lawsuit they file will be dismissed.
