    Default Does a Landlord Have to Provide Parking or Accommodations for Guests

    My question involves landlord-tenant law in the State of: Virginia

    my girlfriend moved. she is renting from a private owner. the rental is on his property behind his house. its a nice garage apartment.. big 2 bedroom above a garage. when she 1st saw it she assumed she would park in that garage or would park in the carport right infront of her rental.

    she was shocked when the landlord showed her where she is to park. she has to park in the driveway of the landlord and then go through the side gate around the side of the house and walk through the back yard to get to her front door.

    the landlord has a big 2 car garage that he parks his and his wifes vehicle. and the daughter also parks her car in the driveway ( paved ). the driveway is pretty big tho. from the road to the garage it is like 2.5 cars wide and can park probly 4 cars maybe 5 back to back from the garage to the road. where she parks it goes 3 wide. she has a small car. honda fit so it fits in there pretty good. i attached a picture for more clarity.

    her lease does specify only 1 parking spot.. ofc she didnt read over it 100%. and at the time she didnt even think to ask. she was told after the she signed the lease where her specific parking was.we used to live together had a falling out and now trying to work through things but there is no where for me to park. she just moved last week. we have seen each other several times.. every time she meets me at a big parking lot.. like grocery store or walmart ( big parking lot so dont get towed ).. i leave my car there and ride back to her apartment in her car...its in the country.. so its about 30 min drive one way. its making things really hard. especially since i work late sometimes and cant get out there until she is too sleepy to drive or already asleep. so this no parking situation is actually going to cause problems in our relationship moving forward.

    my question is does a landlord have to provide parking for a guest? or accomodations to allow more than 1 person to be there? i know VA housing laws allow 2 occupants per bedroom. but atm its like she cant have anyone over. if a friend wants to visit... they cant because there is no where to park. even if her family comes.. same situation. both of us dont know what to do about this. we have been through alot yet now we got 2 vehicles but only 1 spot to park. feels as if she is being forced/controlled by the landlord to not have any company over. can a landlord do that? rent a place to someone and put them in a position that no company is able to come over? what would they have done if a couple moved in and had 2 vehicles?

    i cant park on the side of road.. steep ditches. and the roads u see going beside her place are actually private driveways to other houses way back in the woods, so cant park there. and my car leaks a lil fluids sometimes ( 1995 firebird ) which im sure the landlord dont want oils leaking all over his driveway ( probly 3-4 drips a night ) and the cost to fix that is pricey.

    so atm we are stuck meeting 30 min away and taking 1 car back to her place.

    No; a landlord does not have to provide parking for guests.

    with current situation she is in position where no guests can even come over. how can that be legal? she pays good $ she should be able to have whoever she wants over. w/o having to go pick them up 30 min away.

    It is legal because there is no law that says he has to provide parking for guests. Since no law says he must, he needn't.

    If she is unhappy with the inconvenience of having to pick up her guests, she is free to find other accommodations.

    She should check her local ordinances. It's a bit of a long-shot, but perhaps there is something in the ordinances that could help her.

    The law doesn't mandate guests. The law doesn't care if you can have a social life. You seem to have come up with a situation that allows you to visit (she should also check her lease to make sure she can have long term sleepover guests). Her other option is to go visit YOU.

    I will say this though. If her lack of visitor parking can cause problems in your relationship, the relationship is over before it (re)starts. I've heard of some ridiculous reasons to have relationship issues, but this takes the cake by far.

    I'm not even sure the law requires them to provide parking for the tenant. It's certainly not a landlord/tenant issue here. It may be a zoning issue.

    the parking isnt what i causing our issues. thats a totally different conversation that i wont go into. but with the distance between us now ( 1 hr ) and our opposite work schedules and this parking issue, me coming to see her is now limited to 3 hrs a week..every wednesday i can go spend the night with her. because thats only time that i am off early enough to get out to her before she goes to sleep or i dont have other obligations ( my son ). not sure how we are supposed to work through things if barely ever see each other.

    when she moved there she had all intentions of no more contact with me so she really didnt care about the parking. but 2 days later she missed me and now wants to take this day by day and work through it.

    Quite honestly, your love life (or lack of it with this tenant) really isn't a legal issue for the landlord.
