    Default Lease Renewal with Rent Stabilization

    My question involves landlord-tenant law in the State of: New Jersey

    Hey there.

    I've been a tenant now in the same apartment for 2 years. I signed my lease March 2012 and was up for a third renewal just a week ago. My landlord hasn't yet sent me a lease renewal for this year and upon inquiring about it I was told by the secretary that the place has been designated as rent stabilized and that they're waiting on some paperwork to be cleared (with the city? the state? I was hazy on that) and until it comes in/gets the OK we'll just do a month to month.

    Roughly two months ago I was speaking with the upstairs neighbor, who was in the process of moving out, and he said he was sad to be doing so as he had just found out his unit was rent stabilized (this was before I was told mine is, or is in the process of becoming). So the story does make sense.

    I'm a little nervous though as, with my lease expiring on the first of this month, I don't really have any rights as a tenant. Is anyone familiar with New Jersey landlord/tenant law familiar with this situation and does what I'm saying make any sense? I've never been late on my rent and have mostly been a pretty quiet tenant over the course of the past couple years. Is it actually the case where my status as being rent stabilized is just being cleared with the city/state and I'm just being paranoid?

    I thought the purpose of rent stabilization was to protect the tenant from excessive rent increases. It isn't rent control, as in rent stabilization does permit the landlord or landlady from getting a good return on his or her investment, but that "return" cannot be stratospheric. I don't know why you are worried or why your neighbor moved out. Did his rent go up by more than he expected it to go up ?

    If I were you, I wouldn't jump to any conclusions. Where I live (Northern California), the rents can be atrocious and 10% increases in rent are not unheard of from year to year. I WISH we had rent stablization here !

    Hang in there and don't assume the worst. If you have been a good tenant, your landlord won't want to lose you. It costs $$$ to advertise a property, screen tenants, clean units at move out, prepare move-ins and deal with difficult tenants. If you have never been late, never caused any trouble, you shouldn't worry.

    This probably is an issue governed by a local ordinance, which means that should check the municipal code (or equivalent) for the unit of government that has jurisdiction over your unit.
