    Default Changing Child Custody

    My husband has a son from a previous marraige and his ex-wife keeps emailing us about once or twice a year with a list of behaviors that his son has commited. She always says that she cant handle him anymore and wants him to come and live with us. My husband is active military and I work part time but full time if I want. My husband and his Ex were divorced 11 years ago and the custody was decided at that time. We would love to get full custody of his son but we live in Georgia right now and the divorce and custody order were filed in Texas. I need to know if we have to go back to Texas to process a change in Cusotdy order. Or if we can get one drawn up here and then processed? I guess I am looking for ANY information that will be helpful to me and us in this situation. Also How do I get legal rights for the child also. I know that I will have to have them when my husband deploys. It is a lot of information and confusion for me at the moment. I am not sure yet if the mother will willingly give him to us or not. She has said many times before that she cant handle him and wants us to take him. Any advice will be greatly appriciated.

    He's stationed in Georgia, and will continue to be stationed within the U.S.?

    That's where the court has jurisdiction and that's where the child is, so yes.

    Other than through the "in loco parentis"-type role you have as a step-parent or the unlikely event that mom or a court grants you guardianship, absent step-parent adoption, you don't.

    Next time that happens, take her up on her offer. After six months, assuming no litigation is pending in Texas, your husband can attempt to obtain custody through Georgia's courts.
