My question involves child support in the State of: NY
I have a court date in 2 weeks with my ex for a violation of child support. I pursued the willful violation and the judge told me today it is my burden of proof. Today in court the ncp's court appointed lawyer asked if I could be patient and wait for payment until he found a farm job since "that is what he'd like to do" (even though he has been a mechanic and worked in factories). The judge said to be prepared with documents and/or witnesses since I am pursuing a willful violation. I talked with my lawyer about this matter and he said that this is something I can do on my own instead of me paying him since it is pretty basic. He coached me on what to say (there is a court order that is in place that has not been followed although ncp has potential to pay and get job). I am wondering if I should go ahead and figure out how to subpoena a witness from his last employer (June 2013) to show that he had a job and to see the reason he left. Would it be worth my time to figure out his past employers manager;s name and address or should I just state what my lawyer did.
