My question involves landlord-tenant law in the State of: DC
Hello, I was leasing a 2 bedroom from my landlord with a roommate. I signed on for a year-long lease, but because of his lack of responsiveness to problems with the room I rented (leak, mold, pestilence, no heat), I decided to move; my roommate is staying. I have a papertrail documenting all of these requests. I also have photos and even videos to substantiate the problems with the room.
I managed to find someone to sublet the room and the landlord agreed to the sublet. However, the landlord said my name stays on the lease (because this is a sublet) and that he and the young man would have their own contract.
Landlord has collected security deposit from the individual as well as first months rent, but refuses to give me my deposit until MY lease agreement officially ends.
Can my landlord hold 2 security deposits like this for the same room? As the "sublessor" isnt it between the individual and I? Otherwise this isn't a subletting agreement at all since he and the landlord have their OWN contract together? I have vacated the property, by the way.
Please let me know, because I really think he's taking advantage by having 2 people on 2 different leases and keeping 2 security deposits for the same room and calling it a subletting agreement.
