    Default My Ex Will Not Accept 30 Day Notice to Vacate

    My question involves a relationship in the state of: North Carolina
    My boyfriend and I have been together for 11 years and have a child. He moved in 6 months ago. The agreement was we would split bills in half except our personal cell phones, car insurance, and landline phone. This was a verbal agreement. He has always worked 2 jobs and paid his bills on time when he lived by himself. Unfortunately this is not the case now. He barely pays his part of bills and it has caused our relationship to end. Because I am in a 2 year private lease (not an apt complex or managed by property management) I gave him a 30 day notice. His name is listed as an occupant and not a co-head. I believe I did the appropriate legal action for the state. However, he stated that he never received it therefore he can continue staying. I need to know how I can legally serve him so it will not be my word against his. Thank you in advance.

    Hire a private process server who will personally hand it to him and give you a written record of service that will hold up in court.

    Here's a brief summary of North Carolina eviction law.

    Given the facts, you would likely benefit from retaining a real estate lawyer to handle the eviction.

    The easiest thing to do, though, assuming your ex- is interested in making things easy, would be for him to agree to a date by which he will depart.
