    Question Serving a 3 Day Pay or Quit Notice for Nonpayment of Rent

    My question involves an eviction in the state of: California

    So I went to the courthouse and talked to the legal aid. They gave me the official notice for a 30 day. They also told me that if they don't pay rent this month, I could give them a 3 day pay or quit and get them out sooner. We've had lots of problems with these people. Anyways, Can I actually do that? Also in the lease I drew up myself, it states that rent is due on the 1st and if they don't pay by the 5th, they will receive a 3 day notice. Do I have to wait till the 5th to give them this notice or can I do it by say the 3rd? I ask this because when I gave the 30, they said they would "think" about paying rent when I told them how much the prorated rent would be. Thanks.

    You follow what your lease states in regards to when you serve your Pay or Quit notice. Remember you are a landlord in California which tends to be very tenant friendly. You want to make certain you don't screw up the steps toward evicting these folks.

    Legal aid usually doesn't help landlords, and if that's the advice they gave you, I can see why they're not in the business of helping landlords. Once you tender a 30 day notice, you cannot go back and give them a 3 day. The court will honor the 30 day
