My question involves an injury that occurred in the state of: CA
My 8 year old was playing in the street on a bike and he collided with a woman's car that was left in the road. She had just run out of the car for a few minutes and decided to leave her car there. My kid fell and was hurt, but nothing major. Police were called, they wouldn't do anything about it because we were on private property (the street?) and neither my kid nor the woman were doing anything illegal. I assumed stopping in the middle of a street was illegal, but apparently not on certain roads?
Anyway, my kid received a subrogation in the mail for the damages done to her car. Trying to make sense of all this, but can't seem to wrap my head around the fact that an 8 year old is receiving this subrogation for a significant amount of money. I also can't believe that a small child could cause over a $1k in damage while on a bike going less than 15mph (probably way less than that).
Any advice on what we should be doing here? Or is this completely reasonable for the woman to do and I'm just not aware of these types of things happening?
