    Default Roommates Asked Me to Leave, Now Won't Return Deposit

    My question involves landlord-tenant law in the State of: Ohio

    I signed a one year lease in October 2013 with three other roommates. All roommates are on the lease. I am the only female and they are all of the same age, while I am not. This led to me being a bit isolated in the house, not included, voted against on things, and eventually this created a lot of tension in the house. I was the only one who cleaned and I always paid all bills on time, and I mostly kept to myself in my room. I was not a problem roommate by any means.

    At the end of December 2013, my boyfriend was over and one of my roommates friends was there who was randomly being very disrespectful to me in front of everyone. The last straw was when their friend kicked my cat. My boyfriend stood up and yelled at him; it did not get physical and no threats were made. Three days later, my roommates had voted without talking to me first and decided to ban my boyfriend from the house. I told them he was only standing up for me, and as a rent payer I had every right to have guests over. So my boyfriend still came over a few days a week. I told them if they had a problem with it they would have to pay the fee for my name to be taken off the lease and give me my deposit, and I'd move.

    A week ago they said they would do that and wanted me to move, and I got my own apartment a few days later. The problem is that when I called the management company, they said there is no way to get my name taken off the lease but that I can move and be exempt from bills as long as there is a verbal agreement among the roommates. The only catch being if they get evicted, it goes on my record. I don't see that happening, so I moved.

    Now they are refusing to give me my security deposit back. They want to wait until the end of the lease. They are moving a new roommate into my room and he is going to live off of my security deposit. Shouldn't the new roommate have to pay it like everyone else? Why should I be responsible for the damages the four of them cause the next eight months? Especially when they asked me to leave, promised to find a replacement, and said they would cover expenses?

    Nothing actually typed and signed. The only writing is a few text messages

    Because it's much easier to prove something if everyone signed an agreement regarding these matters.

    Frankly, you did a lot of things ass backwards with this moving out business; got your own apartment and THEN spoke with your current management company regarding breaking your lease. Got a bunch of promises from some less than reliable former roommates but not a whole lot in writing regarding this matter.

    I spoke with my management company about it on Monday and signed my new lease Tuesday.

    Do I have any rights concerning this at all? And if I have proof of them agreeing on me leaving, can they sue me for unpaid future rent? Also, if there is nothing in the lease about it, is there any way to get my management company to take my name off?

    What you can achieve in court depends upon what you can prove.

    You have told us that you have been replaced, so even if they hadn't asked you to move out they wouldn't appear to have any damages.

    You can ask nicely. They can say "no".

    But as a whole, if someone agrees to assume my responsibilities as a tenant, and the other roommates have agreed to resolve me of any future financial burdens, am I in the right to assume this means the new tenant would need to give me his deposit?

    If I can convince them to sign a contract that's worded that way, that says I don't have any more financial responsibilities as of a certain date, could I use that as an argument to get my deposit back? Since any future damages made to the premises after said date would be their financial responsibility.
