    Angry Liability of a Shipper for Inadequate Packaging

    My question involves a consumer law issue in the State of: NC
    I needed to send a computer to a family member. I did not have the original box so I called the local UPS retailer and asked if they pack and ship items like a computer. I was told yes. This was a Mail Boxes and More store not a UPS store. I took the computer to the store and paid to have it packed and shipped to my family member in Brooklyn. I asked to have it insured for $1,200.00 and paid for all services. 3 days later the computer arrived and it was damaged. UPS picked it up the next day and lost it for a week. Then it was in transit for a week before I was able to pick it up from the Mail Boxes and More store. The claim has been denied by UPS stating that it was not packaged proporly. The Mail Boxes and More store has refused to make payment. What options are available?

    Apparently, your issue is with the Mail boxes and More store you paid to package and insure the computer if that is the issue. How was the computer damaged? They might be looking at whether you shipped a broken computer initially. The amount you insure it for is not always consistent with its real value as a used computer.

    It looks as if it was dropped on the floor. The right side is completly broken. They would of seen that when I brought it in and asked them to pack it so it is clear it happened after I gave it to them to pack and ship.

    File a lawsuit in small claims court.

    It is standard operating procedure for UPS to initially deny all claims for damage based on packaging deficiencies where additional insurance is over $100.00. I know this for a fact.

    UPS self-insures packages for up to $100.00. Beyond that it is handled by an independent insurance company under contract with UPS. Their modus operandi is to wear you out on your claim until you "go away." It doesn't really matter if Mail Boxes or you packaged the computer. Mail Boxes may have packaged the computer correctly.

    When you call UPS about a claim for over $100.00 you think you are speaking to UPS but you are not. It is the independent insurance company. You must work your way up the ladder of command in UPS to get any satisfaction. Plan on it taking months and a lot of time and effort on your part to get it resolved.

    Thanks. I see the shipper is a pro at evading facts and denying fault. They are saying that they have assesed the unit a cash value of $400.00. It is clear we will need to go to court. I am dealing with professionals.
