    Default Caught Pawning a Stolen Item - Will Burglary Charges Follow

    My question involves criminal law for the state of: IL

    Someone pawns a stolen item at a local pawn shop. Item is stolen from a burglarized residence that is 300 feet from where the person who pawned the item lives. The significant other of the person who pawned the item is the primary suspect in the burglary. He has not been charged with the burglary as of yet and not clear if the police will ever feel they have enough evidence to charge him. He does have a prior residential burglary conviction so it's not inconceivable he did it. He also approached the victim per reward notice posed and allegedly had a great detail about the items stolen and tried to claim that he had seen them at another residence near by. In other words, it appears that he tried to collect the reward by trying to finger someone else. He was allegedly intoxicated when he went to collect the award.

    Their defense: She had lost her ID and didn't pawn anything. It was someone else who took advantage of them and they are victim of identity theft.

    They do speak of an attorney so they may have one.

    What is the chance that they walk with this one?

    Burglary may be hard to prove, but it's quite likely hat the argument that "it wasn't me" won't fly. Pawn shops are required to check id's and appearance (and in some cases may have additional identification techniques) on items taken there. Illinois theft statutes cover exercising control over known (or reasonably should have been known) stolen property, it is not necessary to prove the person actually took it from the owner.

    Given the tiny amount of information, we'd need to consult the old crystal ball as to the possible outcome.

    When I sold a ring, I had to not only show ID, I also had to leave a thumbprint.

    The pawn shop may also have cameras. If they are halfway decent, it will be easy to id the person pawning.

    yeah I thought about the cameras. I don't know which pawn shop it is or I would call them and ask them... If one can just claim "Oops, I lost my ID." what the heck.... Why have laws to check IDs at all.... Plus I'm sure this is not the first time any pawn shop has had to deal with stolen stuff. If anyone should be vigilant checking, it's a pawn shop....

    Why are you playing prosecutor here? What makes you think the pawn shop has any obligation or even inclination to speak to you about it.

    I'm not playing anything. I don't understand why some of you have to attack everyone that posts anything. If I knew the pawn shop I would have simply called them and asked them if they had cameras. I'm sorry if you consider this playing prosecutor or whatever. Not like I was gonna call them and give them names and ask about this particular case. I posted here because I was impatient to find out how this will turn out. Because I was the one who had to read this person's complete and utter, "Oh, I lost my ID. I have done nothing wrong. I'm the victim here" crap written in 2nd grade English. I'm curious because I wanted to know if the courts could possibly be this gullible. Thanks for the more useful reply earlier though...

    Actually reading an e-mail does not even begin the scratch the surface of it. I must have spent at least 20 hours with these ppl so far. I can't elaborate here. But just the thought of them walking with nothing bugs the heck out of me. In addition to the stuff I mentioned, they appear to be causing other problems for our organization that may involve vandalism of property. If they walk with nothing, what is to stop them from just continuing. We would likely have to either just keep fixing what they trash or invest a large amount into surveillance ....

    Perhaps you'd be more comfortable paying an attorney to help you the next time you get..impatient.
