    Default Can My Girlfriend's Father Evict Me for Not Having a Job

    My girlfriend and I moved into her aunt's home when she decided to move to another state last year. We pay for all the expenses of the place and have no legal lease with her aunt or her father and do not pay rent to either of them. Her father has recently obtained POA over her aunt's property and is threatening to evict me if I do not get a real job. I'm running a small under-the-table home business out of the home and I pay half of the rent and expenses in cash to my girlfriend so there isn't really any documentation recording my payments.
    Does he have the grounds to evict me even though he knows I pay for half of the expenses to live there?
    Can you evict someone you have no lease with?
    Is not having a real job grounds for eviction?

    This whole thing has turned into a real headache and my girlfriend and I are about to just say f-it and move out. But, we really like this place and don't wish to leave if we don't have to. Is there any way to defend myself if he comes by with an eviction notice and the sheriff?

    So he can evict me just because he feels like it? Because he has POA over the property that isn't even his?
    Sounds pretty shitty to me.
    I don't believe I should be allowed to stay on someone's property if I don't belong there, but I pay to live here and have done nothing wrong. Why should he be allowed to kick me out for nothing? We have no legal lease stating that I or my girlfriend are required to have jobs in order to stay.
    What grounds would he base the eviction on?

    Yes, you have a lease - a verbal, month-to-month lease.

    We have no verbal lease or agreement with him. He JUST obtained POA and is now trying to evict me without trying to make a rental agreement.
    Her aunt allowed us to live there without paying rent to her.

    Can he evict me for not paying rent even though we have never spoken to him about rent agreements?
    I don't think he even cares about rent, he just doesn't like me.

    Ohio law would control.

    Unfortunately for you, being classed as a month-to-month tenant, he can evict you without cause. He is not obliged to make a rental agreement.

    So let's say, hypothetically, he serves us an 30-day notice of eviction and then comes by with an eviction lawsuit. When we get to court what would be my best defense? Cause honestly his only defense is that he doesn't like me, that's it. I have never caused him problems, we are not destructive tenants, and his daughter and I have a loving relationship. He's just doing this to be an asshole.

    There is no defense. The law allows him to evict you without cause.

    Welp, I guess I'm just going to have to go to court and plead my case then. Thanks for the info.
    It's lovely that you can just evict people left and right without just cause in this country, really puts things in perspective for me.

    Because you two do not have a written lease, you are assumed to have a month to month tenancy (sometimes called a "tenancy at will" in some states). This is assuming you pay your rent on a monthly basis.

    In a monthly lease situation the lease begins the first day of each month and ends on the last day of each month UNLESS either party provides written notice to terminate this type of lease. Generally this is a 30 day notice that that party wants to terminate the lease. If the notice is ignored, the next step is filing for the eviction through the court system. Both parties are served and both have the opportunity to plead their cause in court but generally there is no reason NOT to grant the eviction in this situation.

    Monthly leases are great for folks who need to move quickly..say for employment purposes or school transfers but they provide little stability for those who wish to remain in a rental unit long term.

    Remember that NO REASON for terminating this type of lease need be provided by the person initiating the termination.
