    Default Unmaintained Wall Heater Damaged Carpets and Walls

    My question involves landlord-tenant law in the State of: CA

    Right now I am fighting my landlord for uninhabitable conditions due to a faulty heater that was slowly killing me with carbon monoxide for atleast 2 years. Because of the soot and other problems that came from the heater, my vision became impaired (I actually had to have cataract surgery at at 33). It wasn't until I finally discovered that my faulty heater was expunging carbon monoxide that it was pointed out to me that I have high levels of soot buildup around my whole apartment. Because of how severe my cataracts were I have had and still have problems with colors which is a reason it was hard for me to notice the amount of soot since each area varies depending on ventilation, temperature and moisture in that specific area.

    Here is my concern. My landlord has proven how money hungry she is and everything is the tenants fault and she shouldn't take responsibility for anything going wrong. My carpets are going to need to be replaced, walls possibly professoinally cleaned and blinds probablly need to be replaced. Not to mention all the mold contamination in the window sills and bathroom that I haven't even been able to address to her because of how things have been handled in the past few months.

    So my worry is that she will take me for everything that is damaged that was actually caused from the soot from the heater. Any suggestions on how to handle this manner? I know i can do a walk through before I leave but the amount of times she and her husband have been here "fixing" the heater, I tried addressing all the soot and I am immediately dismissed.

    Are you stating that this problem has existed for two years, yet you have only just reported it to your landord?

    How long ago did you make the report? Has the heater been repaired or replaced yet?

    (Whoops, now that I found your other thread I see you've already been evicted. The damages issue may have been resolved in the eviction proceedings.)
