    Angry Modifying a Child Support Agreement Based on Changed Circumstances

    My question involves child support in the State of: TN

    When my ex and I separated the separation agreement stated that he would pay what he received from his VA disability for the children which is 94.00 a month for 2 children. I found out my ex was working a contract job overseas so I went to court for a modification, I have been to court 3 times in another state I was living in at the time and the case was dismissed because he had already filed for divorce in the state he was living in. I'm now living in the same state and talked to attorneys and they are telling me because he has been paying me what he was receiving from the VA there is nothing that can be done. He was making any where's from 5,000 to 8,000 a month. Now he is working a minimum wage job part-time. While he was overseas working before I found out he was there, my children would try to call their father and his fiancé would tell the kids he was at taking classes at night then she told the children he was in the VA hospital sick. The children tried to contact their father and it went as far as his fiancé telling them I had an order of protection against their father and he wasn't allowed to talk to them. I was told by my divorce lawyer he made over 89,000 tax free for 2012 and now I'm being told there is nothing that can be done. Really frustrated now as I owe my family thousands of dollar for helping support our children that he should have been supporting. I asked him for help so I wouldn't be evicted from my apartment and his answer was he'll get custody of the kids cause I can't support them on my own. Luckily my family was able to help me with my rent so we wouldn't be evicted. It doesn't seem fair to the children that they have to go without the basic necessities.

    If your husband was disabled and was giving you the child's share of the disability benefit in lieu of child support, that's pretty typical. If he's no longer disabled, you can petition for support based on his present income.

    Have you approached the CSEA in TN to modify/enforce?
