    Default Battery Charges After Altercation with Ex-Girlfriend

    My question involves criminal law for the state of: Texas

    My ex-girlfriend showed up late, and unexpectedly, to my home the other night. I could smell alcohol on her breath. She has been having a difficult time with our breakup. I let her in and, shortly after, arguments ensued. I threatened to call the police because she wouldn't leave. I said something that really angered her and she lunged at me while I sitting down. She took two swings at me and the 2nd one connected with the right side of my face. I reacted by pushing her off me. She didn't catch her feet well and hit the wall; apparently with her face first; as she had a lump on her eyebrow and a busted lip. I have a scratch on my face from her fingernail.

    Directly after, she was threatening to call the police. I told her they would take us both; because we both have visible injuries (I think this is true, but not really sure. I've never been in a situation remotely like this before.) I went and got dressed in case she followed through, but she didn't.

    Things calmed down and she left quietly. She is not stable and it telling the story differently to her friends, even they don't believe her. They know she has a temper and she has been in physical altercations with her own mother before. Before the events of the other night, she had emailed her friends saying she wanted to ruin me for breaking up with her. They showed me. She posted pictures of her face on Face Book, and her erroneous story, but removed it because of the reprimand from her friend who said it was wrong and story didn't make sense. She sent me a text apologizing for posting it and said she would leave me alone. However, she still sends me pictures of her face wanting me to see her bruised eye and lip.

    I don't want charges filed on either side. I just want this to go away. I've never been in trouble with the law and freaking out a bit. If she files charges, what would that mean? What would happen? Should I get in front of it and file charges just in case she intends to?

    No matter what you do you risk charges. The Federal gov't pays incentives to prosecute men for DV. IMO the best thing you can do is not talk to anyone about it and exercise your right to remain silent. if questioned.

    Well that's not encouraging. Would she not face charges as well as she stuck me first? I know it's my word against hers, but I have nothing on my record and she does. I thought since we don't live together, it wouldn't be a DV. Again, I'm inexperienced in these matters, so I don't know.

    Do you still have the scratch on your face? If so, I would recommend having someone photograph it - full facial and close up. And write down your side of events. Place your document and the pics in an envelope and hold on to them in case she does file charges.
