    Default Felon and Firearm Charges

    In the federal court system, if there are multiple felons living in a home and the house was searched and a firearm is found will all people be charged with the firearm? Or can they?

    If they are ALL dumb enough to live in a home where they have access to a firearm, yes!

    Possession is NOT a crime of ownership, it is a crime of knowledge, dominion and control.

    Nobody was on probation but yes I could where it would be. It was a boyfriend/girlfriend and their 18 year old son living in the house. Even if someone has no knowledge of the gun they can still be charged correct? The parents had felonies from 20+ years ago.

    The elements generally include KNOWLEDGE and the ability to exercise dominion and control. No knowledge would generally mean no charge ... or, an unlikely conviction.

    Best bet is always to keep ALL guns out of a home where there are any felons or prohibited persons residing.

    The reason I ask is because the girlfriend and son say they didn't know it was there, but in fact did know but they charged the boyfriend. The son was on unsupervised probation for drugs and underage drinking and not suppose to have guns. Just curious if they would charge the other two also.
