    Default Reapplying for a Job From Which You Were Fired

    My question involves labor and employment law for the state of: WA

    Anyone know of anyone who has been terminated, then re-applied for the same job and how that went? How about terminated but went back to work for the same company in a different capacity?

    It depends on the reason they were terminated and their employment record.

    How it went for anyone else has no bearing on how it will go for you.

    I've done this multiple times since I began working at 16. Sometimes - most of the time - I've gotten my job back with no fuss. But in instances where the company was purchased...well, that's a different story.

    How about you give us something more to go on and tell us exactly what you want to know?

    There are no laws requiring employers to re-hire former employees, no matter what reason said former employees became "former."

    Nothing prohibits it nor requires it. Depends what the terms of your termination were. If it was just that they were laying people off due to corporate hard times, it's not uncommon they would take workers back. If they terminated you for cause, they might be a bit reticent to take another chance on you.

    I have wondered about that too. I'd read an article on age discrimination recently where 6 points were shared as things to watch for. Two of the six fit like a glove. EXCLUSION: not invited to lunches, meetings, left in the dark, etc. HARASSMENT: Being the frequent target of his rage but generally in meetings where nobody from my department was there as he ranted about performance from my group like some lunatic.

    My old company has an hourly union position open and I'd like to get back into the union for a couple of years to shore up my pension before I retire if possible. I already had 9 years in the union before coming to management many years ago. I just lost a 95k per year job under 'at will'. My troubles started about 3 years ago when a great boss left and was replaced by another department head who was a narcissist with an axe to grind. He could barely stay afloat on his own but made some people lives absolutely miserable if they weren't part of his clique. For those on his list, he clearly made a hostile work environment but was caught up in a series of complaints against him and removed from his position but offered a different position in the company. Before he left, he gave me my first and only crappy performance review that this current part time guy used as a reference in my term paper to help support his position when he gave me the boot. This new guy never did give me any level of warning or performance feedback and was a bit of a crap too in terms of not being around much, always wincing in pain because his back was killing him, and generally being short on patience with people when he was around. It was almost as if he were getting revenge for the first guy who may have thought we had something to do with his removal from work. This 'replacement' guy terminated one of my supervisors and then me, for not having done something about the supervisor who reported to me and 'letting' him treat people disrespectfully, etc. I continue to believe that the truth is, my supervisor never did treat people as alleged and a couple of employees got together to bring him down through the complaint line process.

    Being in my early 50s, replacing this income is going to be very difficult for me and I'm very frustrated that a company can just set you on the curb the way me and my supervisor have been put out. Given we're about the same age, the thought has crossed my mind that the companies just roll the dice and what happened to us may become more commonplace as they trend younger and cheaper labor to do their bidding. We were both 20 plus year guys with this company and have considered suing the company either for the harassment related to the first guy they didn't remove that created such hostility for people or the second guy who was similar to the first guy and in my own case, borrowed from a performance review that wasn't his own experiences. For age discrimination as it relates to the second guy but are not sure if there's a downside to that and what that downside might be.

    FYI, the term, hostile work environment, has a very specific meaning in employment law. What you have described does not meet the definition unless you have some verifiable and supportable EVIDENCE that but for your age, you would not have been let go.

    It can't hurt to apply. The worst that can happen is that they say no.
