    Default Marital Home is Worth Less than the Mortgage

    My question involves a marriage in the state of: Washington.

    We are WA state residents and live in pierce county and we want divorce.
    We both agree to share half value of the joint house(which is about $100k)
    But currently we are not getting good value...so if we sell it now we will get way less than its worth but at the same time we want divorce as soon as possible ...so what should we do about this jointly owned house (we don't have any other joint property)?

    Also,currently am not employed so, can I ask my spouse for spousal support and is that
    spousal support is monthly amount or its lump sum one time amount? How much money I can get for spousal support per month as my spouse does not have savings to give me lump sum amount?
    She brings home about $3200 a month.

    We don't have children.
    We got married in nov. 2008

    If the home is worth less than you owe, options for its disposition would be for the home to be sold and for the amount you have to bring to closing deducted from the value of the remaining marital estate, or for one spouse to keep the home and for the negative equity to be split between the parties in the division of the remaining assets.

    You've given us no information upon which to assess whether you would be eligible for spousal support, save for your current unemployment. How long have you been unemployed, and why? Why can't you simply get a job and support yourself?

    You'd better find a job real fast.

    The odds of an unemployed male getting spousal support are slim to none. That's just my opinion, for what it's worth.

    But I suggest you don't just sit around on your butt watching TV while the divorce is going on.

    It's going to depend on the facts, including the reason for unemployment and any reason it may be difficult to return to the workforce, just as it would with a wife.

    We paid off the house ...so we dont owe anything...apart from home there is no significant assets to divide...what is your suggestion now?

    also, I had a car accident and after that I have hard time keeping job..
