    Default Inadequate Heating in Freezing Temperatures

    My question involves landlord-tenant law in the State of: New York

    I live in a rented apartment in Upstate New York. I've looked up tenants rights and it reads:

    "According to the law between October 1st and May 31st building owners are required to provide heat under the following conditions: Between the hours of 6:00 AM and 10:00 PM, if the outside temperature falls below 55 degrees, the inside temperature is required to be at least 68 degrees Fahrenheit; and, Between the hours of 10:00 PM and 6:00 AM, if the temperature outside falls below 40 degrees, the inside temperature is required to be at least 55 degrees Fahrenheit. "

    My apartment does not reach these standards. We constantly have all heaters in the apartment running and our electricity bill is absolutely outrageous. I can barely afford this bill, it usually is the reason I can't afford much food.

    The landlord is aware of our problem but our problem persists despite the replaced heater we obtained. I don't think it makes sense that I pay so much for electricity if it simply just goes to waste. How can I possibly fix this problem?

    How is the apartment heated? Is this a really old building, or is this a situation where the central heating system is inadequate or broken and the landlord simply doesn't want to fix it?

    What community are you in? You can contact the local housing inspector on Monday, and perhaps shortcut the process, but if you want us to look for local information or at the local ordinances that would apply to your unit we need to know where the apartment is located.

    It is an old building and we have electric heaters at the base of the walls. It's 0 degrees today so I doubt it'll get up to 40 degrees in here. The only action they took so far was replace one of the heaters which has a short. It didn't make a difference and it shorted out again so they came back again and "fixed" it and I think it's shorted out again. I live in Clinton county in upstate New York. I understand that the building is old but I don't like that I have to pay 315 for my heaters to constantly run and have it still be so cold in here that I can leave the milk out and it wont go bad. I'm out of here as soon as the lease is done but I hate that I pay so much for wasting electricity.
