In 2004 I was divorced and given full custody and decision making for my two children (I might have the wording wrong, I will check). Last month my daughter died and I have been thinking a lot about creating a will to protect my son (Age 12) should something happen to me.

The kid’s mother has had little to no contact with them since 2006 or so. I have a Permanent Restraining Order as well as a Permanent Protection Order issues in Colorado (where we got divorced). But I am afraid if something ever happened to me; she would try and take custody of my son. This cannot be allowed to happen, under any circumstances. I would like my sister to have custody of my son should anything happen to me.

So my questions are:

1. Would my ex-wife be able to get custody of my son if I died?
2. Would a Will be able to prevent my ex-wife from getting custody of my son and give my sister custody if I died?
3. What do I need to do to prevent my ex-wife from getting custody of my son if I died?
4. What do I need to do to ensure my sister gets custody of my son if I die?
