My question involves a marriage in the state of: Divorce contract done when I was in the military. I still am paying for a car that I let her use, it is listed in the separation agreement that she can have it. Am I responsible for making sure that it is paid off? If so when I receive the title do I have to sign it over to her? I have called the bank about the situation and they told me that the contract was not legal because she has no legal right to ownership of the car, she is not a co signer or anywhere on the lease. She will not sign the divorce papers until the car is paid for and I sign the title over. They actually seemed mad at me that there property was not in my possession (which I can understand) We have been separated for over a year now, she resides in NY where we got married, and I went back home to CA, where I reside now. I have 4 more payments left before the title is released to me. The contract was done on post buy the judge advocate general. So a recap, do I have a legal claim to go get the car back? if not can I just cut ties with that car/her? At the time I wanted nothing to do with her or NY and just wanted to go home, I think that I may have shot myself in the foot by agreeing to the no contest agreement with that car.
