    Default Changing My Last Name to the One I've Used All of My Life

    My question involves name change laws in the State of: Va

    My last name on my birth certificate has my mother's maiden name, and when I started school my Mom put down her married name down to register me in which she was married a month after my birth to my Father. The school over 40 years ago never asked for a birth certificate, just allowed my Mom to register me into school under her last name. I have always used her married name as my last name all of my life, and when I got married then divorced 4 years ago got a court order to change my name back to the name that I have always used. My question is how do I now change my last name on my birth certificate to match the last name that I have used all my life? I would like to apply for a passport and know I will run into a problem because my birth certificate shows another last name or my Mom's maiden name. Do I just do a name change form for Va and send in a certified copy of the last name change from changing my name back from my divorce? Please help!!!

    Is the court order from your divorce specific? In other words, does it state that your last name will become XXXX. Or does it say that you are taking back your maiden name without being specific?

    It states: the Petitioner shall be awarded the restoration of her maiden name Cxxxxx Mxxxxx Lxxxxxx.
    Which is the name that I have always used.

    The more I think about this the more than I think you might have a problem, even though the divorce orders are specific.

    Usually, when it comes to a passport application the process requires a clear, documented line of name changes (mostly applicable to women)

    You have the BC which proves that you are a US citizen...born in the US. But you have no proof that you are the person listed on the BC because you cannot demonstrate where your name changed from the BC to the name that you used, to your married name, and then back to your current name.

    Unless when you got married the paper trail got created...do you recall any difficulty adopting your married name when you first got married?

    If your parents are also still living you should ask them about documentation when they first applied for your social security number. You are old enough that they did not have to apply for your SSN at birth, and in fact may have obtained it when you were much older...maybe even a teen...your parents may have documentation.

    I applied for my SSN when I started working as a teen in Va. I believe I used my drivers license to apply for my SSN that I got at age 16 in Va as well. I had know problem in Mn to get a marriage license at all, so no paper trail to connect to my birth certificate. What a mess.

    Unfortunately its a mess that you need to deal with now, because its also going to be a mess when you retire as well...and its best that you deal with it now while your parents area still alive...assuming that they are.

    The state says to contact Special Services to determine how to correct your problem.
