    Default At Fault Car Accident While Uninsured What to Expect

    My question involves an injury that occurred in the state of: Michigan

    Thanks in advance for your help; I got into a minor car accident earlier today (front end damage on both cars) while driving uninsured. I know that is horrible, but I received a ticket for no proof of insurance/registration, and failure to yield. At the time I didn't know if I was uninsured or not, so the police officer said the proof tickets were able to be easily corrected. I did not exchange info directly with the other driver, but a police report was filed. I am expecting to pay for the damage to the other vehicle, but am poor (hence no insurance) with only 5k or less in the bank. I am scared of losing my license or going into financial ruin and was hoping someone could shine some light on this issue. Specifically:
    Can I get insurance now to cover just the tickets, and myself from this point forward?
    Do I have to set up a court date?
    Do I tell the court clerk that I was not insured for the time of the accident as prev thought, or will they come to me regarding a settlement?
    Can settlements be resolved quickly or do they involve multiple lawsuits?

    I know I am wrong, but please help. I am terrified and can't breathe

    MI is a no fault state. You can be held liable for up to a $1000 mini tort for property damage and gone after for medical.

    An uninsured driver is not subject to the mini tort caps. You can be sued (by the other party's insurer) for actual damages.

    As Ron stated if you do not carry at least the minimum insurance required by the law you remove the protections of the no-fault law. If you do have no fault insurance, your medical is covered by your own insurance as well. That would mean typically, if both parties have insurance, you are nearly immune from liability greater than $1000 unless their is a serious injury or death. At that point the at fault party can be sued for some specific damages. Your own insurance still is liable for medical treatment...... For the rest of your life.

    amend:

    the medical coverage continues for life but after a specified amount a state medical fund picks up the tab.

    Thank you; I hope I didn't post in the wrong forum; there were no injuries, just property damage. The other car had what looked like a dented/crumpled bumper?

    I plan on obtaining insurance for current post accident coverage and to cover the no proof of insurance ticket, then paying the failure to yield ticket, and finally waiting for the other party's insurance to contact me with a bill. Could you tell me if this is a good course of action? I don't want to get myself in any more legal trouble

    the lack of insurance cannot be fixed. You didn't have insurance. Obtaining insurance now may cause a judge to be lenient with any punishment doled out though.


    Your insurance is going to have to be purchased through the "pool" and due to that, it will be more expensive than it typically would be.

    you cannot purchase retroactive insurance so any coverage will be from the date of purchase forward. If your car is still registered, you best have purchased insurance before any hearing as it is legally required to have. If you do not have insurance, do not drive your car until you do. You could be subject to another ticket if caught.

    there should be instructions either on the ticket or given to you along with the ticket.

    well, part of any hearing or trial will be where you are given the opportunity to show you did have insurance at the time. Since you didn't have any, obviously you cannot show them you did.

    if you do not dispute the amount sought by the injured party, there does not need to be a lawsuit. As to who is going to contact you: if the other driver did not have collision insurance, it will have to be the driver. If they did have collision coverage and avail themselves of it, their insurance company is likely who will be contacting you. I would wait for one of them to contact you though.
