    Default Denied Job Due to Inconsistency Between Application and Prehire Background Check

    I live in Utah and on new years eve of 2011 going into 2012 . I was giving a ride to a relative and was pulled over due to my plates being expired. Later I found out that they had a open container in the car that I was unaware. The cop still had to give me a ticket since it was my vehicle. I called to pay the ticket a week later and the courthouse said since I had no prior tickets or violations that it would not show on my record. Recently I applied for a job and found out it was on my record and I got denied employment due to the fact I didn't match my answer to my background check. I was 19 at the time of the incident. Can this effect me from getting a job if I do list it on an application? Would trying to get it expunged be a possible choice?

    If you give a false answer to a question on your application, even if you think you are giving the correct answer, that's a valid reason for a prospective employer to decline to give you a job.

    You will have to investigate expungement laws for your undisclosed state to see if they extend to your offense. Within any given state, the answer could also hinge on the nature of the statute cited as some states don't permit expungement of traffic offenses but (again depending on state law) DWLS may fall under the criminal code.

    And I will include that in any state, if you answer one way and a background check turns up a different answer, in the absence of a law that EXPRESSLY gives you the right to answer the way you did despite the facts, those are legal grounds to deny you employment/fire you if already hired by that time.

    By expressly, I do not mean the absence of a law that says you don't have to answer Y. I mean that there IS a law that states, "You may answer X even if Y".
