I'm hoping to get some advice on this particular situation. My 18 year old son got into an argument with his now ex-girlfriend late one night over the phone. Being upset, he decided to go for a walk to cool off. We live behind an elementary school so he wound up there in order not to go too far. He was there for maybe a 1/2 hour when the police showed up, asked him what he was doing there, and promptly issued a complaint - summons with the above code. The statement is :"Within the jurisdiction of this court, entered and surreptitiously remained on school property (Drew School) knowing that he is not licensed or privileged to do so, specifically by entering school grounds (playground area) and remaining there after hours for no legit reason. In violation of 2C:18-3A"
After speaking with an attorney, it turns out that the code is incorrect. This 3A code is for entering a building. But anyway, this is his first offense, even as a juvenile. He has never been in trouble with the law but now he faces the possibility of having this on his record. We cannot afford an attorney because we've been getting quotes of $1,500 to handle this. This particular summons carries a fine up to $500.00.
Does anyone have any advice to give me? We've gone to the first court appearance this past Monday where we were told that the judge is putting in a not guilty plea so that we can obtain an attorney. This is all new to me. We have a second court appearance on the 27th of Nov. I'm thinking maybe I should contact the prosecuting attorney to discuss this beforehand to explain the situation and possibly have it either reduced in fine, or the type of complaint, or possibly even have it dismissed.
