    Default Parenting Time Denied

    My question involves a child custody case from the State of: MN

    I have sole physical and joint legal custody. Court order says, "Unless otherwise agreed to by the parties, the Respondent shall have the right of parenting time with the minor children of the parties which shall include, but not be limited to Thursday at 5 PM to Saturday at 5 PM."

    Last August, he agreed via email to change this to week 1 Friday after school to Saturday 6 PM and week 2 Friday after school to Sunday 3 PM.

    A few months ago he asked me if we could add Thursdays back in and I said I didn't think we should change it now since the kids were already used to Fridays this school year. He sent me a few more emails asking for Thursdays, but I had already said I don't agree to change it back. Currently we are in dispute because he wants Thursdays and I don't agree. So this week we are going back to the court ordered time of Thurs 5 to Sat 5.

    Can he now claim that I have denied him parenting time on Thursdays?

    Yes, he can claim that. How the court reacts, I can't guess.

    Seriously - and I'm certain we've already gone here - have the kids ready, and file to modify the current order.

    Yes, I just read the same post with some different wording!
    The reason the order states that "Unless otherwise agreed to by the parties, the Respondent shall have the right of parenting time with the minor children of the parties which shall include, but not be limited to Thursday at 5 PM to Saturday at 5 PM."
    is because when you decide to agree but then disagree (via email in your case), you revert back to the schedule of Thursday at 5 PM to Saturday at 5 PM, unless you can otherwise agree to the other schedule. So as Dogmatique advised in the other post, file for status quo if you want to try to get it permenantly changed.
