This is a county clerk in Texas.
Last year we were served with a law suit sometime in April. When we appeared in court scheduled for sometime in July, the judge put a lock on the property in dispute and pretty much said in some legal term I can't remember that no new documents could be created. We could only use documents that had already been filed with the county clerk, and any new documents would hold no grounds in court or something like that.
So after that ruling, I went to the court house and looked up the names of those involved in the lawsuit including the property description to make sure I got all the documents that were already filed. I know how to use a computer and I know how a search works, thus I did not rely on just one keyword to make a search. I used a combination of keywords, including mispelled ones just in case it was misspelled. I also used wild cards in my search to expand it. I am pretty positive I got all the documents filed from before July.
Sometime in August I was told to go and check if the other party had filed anything new against the judges orders, because not to make our side seem better, we have a history with these people and know how corrupt they can be and that they have connections that can help them with their corrupt dealings. But I did not find anything.
In January 2014 we had court again. Nothing big, but after court we went to the courthouse once again and did a search. Nothing new.
However, the January court date was not a good one for the other party. Pretty much, they have failed to submit their answers and have not provided us with anything our lawyer has requested. The judge gave them a deadline, on top of the ones they had already missed. When they missed those deadlines again, our attorney filed a motion to compell and set a date. The day before we were to go to court for the motion to compell, the other party finally answers, submitting everything that had been requested including two documents that I had never seen before. These documents had been filed last year BEFORE our first court appearance, and I found this very strange because I know I did my searches right and this document was definitely not there before. So I rushed to the court house and did the simplest thing, something I KNOW I did before, and that was just type in my name in the search engine, and what would you know? This file now shows up!
Now, I know how to spell my name. There is no doubt in my mind I have done this search before and this file WAS NOT there.
Things of importance: This file that was not there but now is is a testimony in favor of the other party, and it is given by a very powerful and corrupt politician in our area. This man works in the court; he's a member of the board for the appraisal district, and he has harassed us before acting very unprofessional by going to our house to argue with us and taking off spinning wheels. On top of that, someone who speaks with this man warned us a long time ago that this politician had said they were going to forge some documents that would "destroy" our case. Weirder still is that these files were supposedly filed in May of last year, but when they served us in June, they did not provide these documents to us. They did not provide these documents to us later that year when they submitted some unsatisfactory answers. I have no doubt something wrong is going on here.
But after going to the court and doing everything I could think of to see if they manipulated these documents, I can't conclude whether they are just really good at hiding their crime or whether I really just did miss this? I mean, the patterns seem to be correct, and I went through every file filed that day. The only inconsistency I could see, which isn't ground enough to claim fraud, is that both documents were signed by the same employee. One of those documents was filed days later, but it happened to be the same employee and while for each day, only 20 documents (more or less) were filed, those were the only documents signed by that employee those days.
So I asked the employees there if I could get a the time-stamp from the computer that records when these files were input and they told me there's no way to do that. I know there is. I also believe they use a third party software and more than likely these records run through a server, but while I am computer savvy, I don't know if it is possible to get a time stamp for the time it went through the server?
However, my main question is this: I have only done my search through their computer software and checked the files in their library, but I am wondering if a county clerk keeps a separate record of what he files? Like maybe a sign in sheet, or a hand written computer log that maybe they are required to keep like a notary public.
Also, how can I go about investigating this further? In other words, who can I contact that has authority to go in and catch these people by surprise and investigate them? The FBI?
I really don't want to ask the county clerk for their help, or anyone in the court house because of the level of corruption that goes on here. It's a small town and I fear I might end up alerting the wrong people and giving the other party clue to cover their tracks better (if indeed there is corruption going on with them).
