    Default Adult Stepchild of Now Divorced Parent and Stepparent

    My question involves estate proceedings in the state of: California

    I think my question is going to affect a lot of people!

    My father remarried when I was an adult. They are now divorced and the stepmother really cleaned up and took almost everything in regards to real estate and money. My father died shortly after in poverty.

    When she dies can I claim some of her estate? I don't expect to be included in her will. She has children from a previous marriage or two.

    Would you be entitled to distribution from her estate? Only if she were to die testate, her will should be admitted to probate, the estate is solvent and you were a named beneficiary.

    As far as stepmom's ransacking, she may have helped herself to some of dad's personal property, but she could NOT have ousted him of any of his separately owned real property unless, 1) he deeded her an interest, 2) it was distributed and set over to her in the divorce proceedings, or 3) through the probate of his estate. And since you say that he died impoverished, the latter seems unlikely.

    Also, and with all due respect, the only "affect" your question might have on others is that some might consider it a bit naïve.
