My question involves labor and employment law for the state of: Colorado
I have been seeking employment in production for over a year. I applied at a company recently and was called in for an interview. At that interview I was hired, pending a clean background check, and u.a. I had no worries about these things, filled out the hiring paperwork, and was excited to start the next Monday as a production machine operator making motherboards and components for different electronic parts. This was for a small, privetly owned company.
A few hours after leaving the interview, HR called me and said my background was not satisfactory and they withdrew the job offer.
I asked for, and was mailed, the copy of my background check and info on the company that performed the check.
It is my understanding that, by law, they can only go back 7 years (or 10 for bankruptcies).
I do have a felony conviction from 1998... (For second degree burglary)15 years ago, but this info was sent to my potential employer.
This charge has not shown up in any of the other numerous checks that have been done in this past year.
Also, in that same paperwork, it says "years searched -7"
So you see my confusion, they stated they only searched 7 years but sent 15 year old info. And as a result, I 'lost' the job.
I submitted a complaint via telephone with the authorities. (FCC?)
Now I'm wondering, do I have a case against the background checking company?? For costing me the job? Due to 'digging too deep' (the correct phrase escapes me)
I'm still unemployed, and as a result, I'm going to lose my house.
