    Default Will a Chapter 7 Discharge be Issued While Filing Fees Remain Owed

    My question involves bankruptcy in the state of: Ohio

    My husband and I filed a Chapter 7 in October, and had our 341 meeting on December 5th Today, February 3rd, is listed on Pacer, for our case, as being the last day for creditor objections. I know that normally, discharge is granted a few days after that day.

    We've been paying our filing fee in installments, and the last payment was originally due today. Our attorney filed a motion for an extension, for us to pay it by February 15th however, due to my being out of work, and unable to pay it by today.

    Will we still get our discharge possibly sometime this week, or will it not happen until after we pay the last filing fee installment?

    To clarify, it's not attorney fees we owe. We've already paid our attorney. The fee we have left to pay is our third court filing fee installment

    I'm asking because we're surrendering our vehicle in the bankruptcy, and I'm trying to figure out when the lender will come get it. I assume they'll wait until after discharge, but I don't know when we'll get our discharge.

    If you fail to make any installment on your filing fees when due, your bankruptcy case is subject to being dismissed without discharge. It is difficult for me to believe that the court has scheduled discharge to occur prior to the date it set for the making of your final payment toward your filing fees.
