That would depend. In any circumstance you have not notify CIS that you got married. If the person is already a legal US resident (even if not a citizen) it shouldn't be an issue. If they are NOT, it might indeed be an issue.

Unless he's sponsoring the fiance, he's under no legal obligation to inform USCIS of the marriage since it doesn't affect his residency or his naturalization at all.

Even then, the fiance's status isn't a problem for him, in the legal sense. It could be a problem for the fiance, though
