My question involves collection proceedings in the State of: OHIO
A creditor/collection agency claims to have notified me of their suit against me. I did not receive notification. Because I did not respond, they obtained a judgment against me. This all happened without my knowledge. Upon viewing this via my credit report, I contacted the agency for proof that this was in fact, my debt. I believe that I settled on all outstanding debts back in 2009. I would like proof that this is mine via statements from when the card was opened in 2006. If they cannot produce proof that I opened this card and ran up the bill, I hope the judgment can be erased. An employee at the law firm told me that it was impossible to produce statements, and that if I wanted to dispute it, I would need to file a police report. The thing is, I want to be 100% certain this debt is not mine before I would do something like that. I assume there are consequences for filing a report if I'm not 100% sure, right?! Please help.
