    What are you looking for? If they held him too long before he was arraigned, he needs to present the issue to the court. Since he has since been arraigned, I suspect nothing is going to happen. Since bail has now been set, he either pays the bail or he sets in jail until his trial.

    He was released on OR in the Felony case, but kept in custody anyways which is a violation of PC correct?

    Bail was set the minute he was booked, on the Felony case he has another court date in March would being kept without legal veracity to do so be considered unlawful imprisonment? And consequently because he was unlawfully held he was also disciplined simply for asking to speak to someone who has authority about his situation.

    Could this be brought up on his next court date or is their some form of compensation he is owed?

    no.

    Bail was set the minute he was booked,
    bail on what? bail on the warrant wasn't set until he was arraigned which you say wasn't until Thursday. The fact bail was set on the felony is irrelevant to the warrant issue. Since bail has since been set, he can either pay the bail or set in jail waiting to go to court on the warrant issue.

    Dude JK - Read the OP.

    Bail was set for the Misdemeanor WARRANT at $26,000 that was the bail amount for the warrant. The Felony Bail was $60,000 total of the two was $86,000. The judge on the felony case on Tuesday released him on his promise to appear.

    There was a bail amount for the warrant most warrants, unless juvenile have a set bail amount.

    The fact also remains that he was not brought before the court on the warrant for an excess of 48 hours as prescribed by law. Correct?

    The judge on the felony apparently released him OR regarding the felony but apparently not regarding the warrant.

    if you believe otherwise, hire a lawyer to represent your friend. I suspect you are not truly aware of what actually transpired in court or do not understand what was said.

    @Jk - it's two different courthouses with two different judges.

    Please elaborate on what you believe I do not understand, I was at the jail within an hour after he was booked, got all the information, went to the first court appearance for the Felony case on Tuesday, and he did not appear in court for his WARRANT until Thursday. The law prescribes that if arrested or booked for a warrant you must be brought before a judge within 48 hours excluding Sundays and Holidays, he had a bail amount for both thing the felony and the warrant which totaled $86,000 and was ordered to be released on his promise to appear for the Felony case in which he was arraigned within a lawful amount of time, however he was kept in custody by the LASD unlawfully for an additional amount of time exceeding that that is prescribed in the CA PC.

    At least this is what I have seen, heard, and to my knowledge verified, please explain how and why I am incorrect to enhance my understanding.

    Then the warrant was NOT for a simple traffic ticket - sorry.

    He will be released when he posts bail (and he can always ask for a bail reduction at his next hearing), or, when a judge orders him release on his own recognizance on the warrant.

    The same rules for arraignment do not apply for warrants depending on the nature of the warrant which is something we do not know.

    Since it's clear YOU do not have the necessary information and this is NOT some simple traffic offense, you can be a big help to your pal by helping him engage an attorney. You are not going to be able to help him out of his mess by trying to play Clarence Darrow.

    so why do you keep preaching that the judge on the felony case released him on OR yet you are upset he is still in jail? two different court houses, two different judges means he has a $26k bail to pay or he is going to set in jail until the warrant issue is dealt with in some manner.

    @Cdwjava- Here's what the warrant was for: He was pulled over in Pasadena because his passenger was not wearing a seatbelt, upon a DMV records check it showed he had a suspended license for FTP. He was cited and released by the officer.

    He lost the citation and contacted the court several times in an attempt to retrieve the information about the upcoming court date for the 14601.1(A) case. He had no citation number to give so he provided his license number, but the clerk stated on three occasion that they had no citations in their system as of that point (one month after he had been cited) and to keep checking.

    A month later in January he was arrested for the felony case and upon an NCIC check it revealed he also had the Warrant for the traffic case which was a misdemeanor because he did not appear for arraignment because he lives in Ventura (80 miles from the courthouse) and contacted the court numerous times but failed to get any information on his court date and/or time.

    He was booked for the Felony and misdemeanor warrant each had its own and a separate bail which totaled 86k.

    Now assuming for arguments sake that all the above information is accurate and the previous information posted is accurate, then what? Was he legally held even though it exceeded the 48 hours as prescribed by law, etc...

    I reiterate, HE SHOULD SPEAK TO AN ATTORNEY!

    The bail is $26,000. Unless it is reduced or he is released O/R he stays. YOU cannot play any legal games to try and get him out. HE cannot play any legal games to get himself out. There may be things at play that you are not aware, or it may simply be that in LA County an FTA for a suspended license ticket is $26,000. Of course, it may also be as a result of prior FTAs or other offenses.
