    Default My Landlord Broke The Law

    When my landlord decided to sell the house we are living in, he made us lie about a problem in the house. He said if we didn't, he would make us move out. He was afraid the house wouldn't sell if potential buyers knew of the problem. We didn't have anywhere else to go, so after he covered that area, we kept it covered up. They never gave us any deposits back after the house sold and we're still living in it. He is a big business man and knows we can't afford to pay anyone to call him on it. Any advice?

    If your still living in house then are you renting it from new owner? Your post doesnt make sense. The owner can sell his home if he wishes and unless you have a lease can ask you to leave at anytime providing he gives you proper notice. It sounds as if he did. Your having nowhere to go is not his problem and I dont say that to be mean its fact. If you want help then answer the following.

    Do you have a lease? If so is it month to month?

    How much notice to move did LL give you?

    Has new owner contacted you to move or pay rent?

    I have a new lease from the new owner. It is not a month to month. We were never given any notices to move, from anyone. The old owner sold the house and never returned our deposits that are on the previous lease agreement. What doesn't make sense? He lied to potential buyers. And he withheld important information regarding the house. In Arizona, that's breaking the law.

    The new owner is to return yor deposit when you move he/she now owns lease. Since you have not moved you are no tintitled to your deposit back yet

    The house has totally changed hands. The new owner did not require any deposits. Our old lease states we put down a $500 security deposit and a $1500 indemnification deposit. Both refundable in the event we either move out or the house is sold to a bona fide purchaser. This is supposed to take place 14 days after.

    You did not mention that before. I would contact previous owner first with this document and then new owner. Based on you last post you are entitled to monies.

    Never-the-less, what about the part where he lied to prospective buyers? Is there something that can be done about the fact that he with held important information regarding the condition of the house? He threatened me in front of my children if we didn't comply.

    Are you in AZ? What kind of certification do you have?

    If you want certified help I suggest you hire it! You get what you pay for here. Far as lie goes what gain is there for you in this? It surely wont help the return of your deposit by making waves with former Landlord. Go to new owner if you like and inform him/her. If you can prove the threat you "may" have a civil suit.
