    Default Failure to Complete Community Service for a Deferred Sentence

    My question involves criminal law for the state of: California, Fresno county.

    My husband was convicted of felony evasion in February of last year.e judge gave him probation for a year until Feb 6th this year when he's supposed to complete 1000 hours of volunteer time and pay the max fine of about $6000. He said if this was completed, he would reduce the charge to a misdemeanor. We've paid all the fees and he completed the hours by teaching friends and family cpr, but probation told him in July they required a non-profit organization to complete the hours through. However, they would not give a court referral for any non-profits. So with this conviction he hasn't been able to volunteer for any non-profits until about November of this last year. So he only has about 150 hours done, perhaps 200 by the time we go into court. What is the likely outcome and what can we do to present this? My husband has tried tpp contract probation many times, each resulting in no help or answers and now our lawyer is suddenly saying we need some form from probation indicating completion of hours....

    The criminal department of the courthouse should be able to tell him where a Volunteer Center is for him to register. You know why they don't allow criminals to choose their own community service projects? Because they lie.

    The courts have LONG since stopped allowing you to do whatever you wanted or volunteer at your mom's day care or your dad's church (because they won't actually make you do anything).

    Are you telling me in all of Fresno County your husband couldn't find a city parks and recreation center? A YMCA? A police department, The probation department? How about the ever so popular CALTRANS?

    One very quick google search found me the phone number to the Volunteer Center of Fresno County. The agency that does court referrals. I also found one for Sonoma County...

    they're all over the state. We use them in Southern CA as well

    What I'm actually saying is that we live in san Bernardino county and instead of transferring departments , they kept everything in Fresno. So without actual paperwork from Fresno the court referral programs down here won't work with you. Their only suggestion was salvation army who has limits on how many hours you can do per week. As I'm sure you can figure, 1000 hours is a lot more than a couple hours a week.
    Additionally my question was less about pointing out errors and more about what to expect from the impending court date.

    All he needs is a minute order from the sentencing date. You wanna know how I know? Yeah, this is what I did for a living for many many years. What you can expect? Anything from an extension of time to jail time.

    For some reason, and yes I know this sounds ridiculous because I was taken aback, the court referral program office stated because the case was outside their county we needed a specific paper from Fresno before proceeding. I'll have to look back to find out what they needed.
    I don't suppose off hand you know what form specifically we need from probation for the court appearance?

    It's usually the sentencing sheet. A copy of a long legal sized (or longer) sheet of paper usually with a bunch of check boxes and fill in the blanks that tells him how he was sentenced. They sign them sometimes. The courthouses in LA County will also use a certified copy of the minute order which serves as a copy because defendants often lose them. That should be sufficient.

    Is he on informal or formal probation? Informal being, he doesn't have an officer he checks in with, he just has to stay out of trouble.

    Thanks. I had thought it was to be formal probation, but besides the monthly report forms that he turns in to Fresno and San Bernardino - no one checks in with him.
