That's what I was thinking, yes.
At the moment, Mom hasn't actually done anything illegal (the school attendance issues might be a problem though). The school legally cannot stop her from taking the child.
CPS has basically decided that there's no proof of any wrongdoing, so they'll close out the case.
Please understand though, that Mom has rights. She does not have to cooperate with CPS, and since she hasn't done anything illegal the police won't do anything. There are no court orders, correct? In that's the case, she's free to come and go as she pleases, with or without the child.
As far as the State is concerned, Mom needs to actually get their attention before anything will happen.
