    Default Can You Be Charged an Impound Fee for a Stolen Car

    My question involves a consumer law issue in the State of: ca


    My car got stolen last night.

    I reported it to the police they feel confident they will find the car.

    My questions is when they find the car. Does it automatically go to impound? And do I have to paid a impound fee and towing fee?

    If the car is total. Can they legally make me pay the impound and two fee if I don't want the car.

    I only have liability insurance on the car. Insurance will not pay this fee.

    Or is this like you car got towed. If you don't paid the towed charged they will auction your can and if the auction amount it not more than the fee they will try to collect from you.

    In CA, they can come after the owner for excess impound fees I believe. Your recourse is to sue the thief.

    If it is feasible, they may give you aphone cal to come to the scene and recover the car. Otherwise, they will tow it until it can be turned over to you.

    Yes, you - or your insurance company - will be responsible for the tow and storage fees. Many police agencies will waive their processing and release fee, but tow companies won't.

    You or your insurer will be legally liable for the tow fees, yes.

    Then you will be on the hook for any tow and storage fees should it be towed.

    That's precisely what will typically occur.

    The other things is Generally the owner cannot be held liability for actions cause by a thief. The owner generally cannot be held liability for any damages caused by the thief. The towing and impounding of the car is cause by the actions of thief, right. Then how can the owner be held liable for the towed?

    And if the owner is held liable for the tow wouldn't the insurance company have to paid? Even if the owner only have liability insurance?

    If you can quickly work out a deal with the tow company, sure. Some people agree to sign it over so that the tow yard can auction it right away or sell it for scrap.

    Yes. You don't expect the tow company to lose money, do you? The law enforcement agency may waive THEIR fee, but the tow company doesn't have to. If a thief is ever identified (and most often they are not) then you can sue them or seek compensation at sentencing.

    Not all policies are created equal. Many don't cover theft or related expenses.
