How Will a Prison Record Affect a Custody Case

He just got out of prison right before xmas. was in for 6months. He had her for almost a yr before going this last time. When he went i went and got her. Before that is was when she was 1 and kept her for a yr and i couldnt see her at all. Then when she was 2 i was able to go get her causr he went t prison..and he wants full custody.

How on earth is he going to explain that your child lived with him (without you living there too) while he was in prison for 6 months just ending at Christmas?

Ok so i tryed yo do something about it but the stupid cops around here are stupid and said theres nothing they coul do to help and that being said is because he works with them as a snitch. And i dnt know how hes gunna explain that....i cant wait to hear it myself.

The cops would not have helped you because he is the child's father. Therefore the child is his just as much as yours. Has nothing to do with him working with them. In light of everything else you posted, that sounds ridiculous. There's no conspiracy here. It's a civil matter, and law enforcement across the country generally do not get involved in civil matters like these. It's really pretty standard.

And what does he have to explain? About why he kept her for a year? If you knew where she was and did nothing about it, that makes it look like your problem and not his. You let him keep her. You effectively abandoned her for the year.

Your recourse involved using the court system. You didn't. Whether or not you knew to do that, in a whole year's time you never tried to figure that out. That's entirely on you.

No i didnt abandon her. And hes not provin to be the father. Hes not on the birth certificate so he has no righys at all. I was told this from a judge. Weather he is ordered to pay child support or no he has no rights.and there was nothing i could do if u knew him i would understand it all and y. And likebi said i have no money but enough to pay bills. So there wasnt the option to go to court about it. But whatever thanks for what help u guys did give me. I will figire it out alone i guess. Hes a felon so ive been told he jas no chance by a lawyer the other day. Thanks

If he's been ordered to pay CS, paternity has been established. Perhaps you misunderstood the judge.

No there is no judge involved right now so i didnt misunderstand nothing. He is not on the birth certificate and thats what he wants. To do that he has to get the test done. So he has no righys. Ive talked to a lawyer and she told me the same thing. Even if he has to pay child support, until he has that test done to prove hes the father he has no rights to her. Im sorry if i sound mean about this but my lawyer said i do not have to let hom have her or see her until its provin in court.

Well this is quite a mess. Someone has raised this girl for a year and you just called the police and filed a complaint and left it at that?

You're not understanding. If there is an order for child support, paternity IS established.

If your lawyer told you otherwise, you need a new lawyer.
