My question involves bankruptcy in the state of: IOWA
I filed a Chapter 7 several years ago. Last year sometime I received the first notice I was being billed for taxes from my 2005 return. As I was told taxes beyond 3 years are discharged, I had ignored the notices. I have meant to send in copies of my bankruptcy papers, but never got around to it.
A while back I received a phone call from a bill collector demanding the $5k right then. I told him it was included under my bankruptcy. He told me I had no idea what I was talking about and that he knew the law and my bankruptcy doesn't cover tax debt. I said I believed it did and I was not paying something that I believe was covered. He then stated he would document my refusal to pay my debt. I told him to document that I filed bankruptcy.
I just received a notice that they are garnishing my wages through my employer, giving me the name of my employer. They also stated because I owe taxes, my ability to renew my motor vehicle plates has since been blocked as well.
My 2005 taxes were done by a reputable accountant. They were late, and perhaps that is what the fee is for? I don't even know. My taxes were filed in 2008. I was going back and forth from IA and CA and didn't get 2005/2006/2007 done until 2008. He filed them all together.
Any thoughts? Wondering if indeed they should be discharged, but now wondering if only Federal taxes apply under bankruptcy...? I'm single, I work part-time, and I am a full-time college student. I can't afford this...and I just don't know how to start.
