    Default What are the Chances of Getting an Attorney Fee Award

    My question involves child support in the State of: California (Butte County)

    So I've hired an attonery b/c the father and I cannot see eye-to-eye and his girlfriend is getting involved.

    My question: I noticed that my attorney is asking for the father to pay for attorney fees (even tho I already paid the retainer fee) and I wanted to know what are the chances that the judge will grant this request?

    Its a fairly common thing for an attorney to put into a petition. Whether or not a judge might grant that depends entirely on the facts of the case. When judges order one party to pay the other party's legal costs, its usually in situation where the one party has been particularly uncooperative in the legal process, or has tended to file frivolous motions.

    ah okay. makes total sense why my attorney put in the request b/c the father has been uncooperative and I have been forced to seek legal representation in order to seek child support b/c recently my car was egged, he refuses to accept that he cant take the newborn out of my home b/c I am breast feeding and even tho I have offered him two hrs three times a wk at my home to bond w/ the baby, he hasnt shown up or responded to me. He hasn't filed frivolous motions w/ the court but has fabricated frivolous lies through false police incident reports (twice)... the first time around it got him a TRO which I then dropped to allow him an opportunity to shape up. the 2nd time around I simply spoke to police and explained that he's fabricating stories to build a child support/child custody case against me and they took down my statement.
