    Default Getting into the United States While Under a Ten Year Ban

    Hi my name is Luis,
    I was denied a visa based on sections 212(a)(9)(b)(II) and 212(a)(9)(c)(I) and given a 10 year ban. I will be eligible in 2021 to apply again. My question is - do I have to repeat the process starting with the I-130 again and pay all the fees involved including the medical?

    My wife has a handicap son. When they asked me about our family, if my wife and I had kids together I said no. Jason is only my wife's son but, she takes care of him. We try to be together but her son was not able to handle the pollution of my country and ended in the emergency room. Can I appeal base in the information I omitted about her son?

    I was also told that there was no pardon available in my case.

    He is a US citizen leaving in the United States. He has mental issues when he gets stress.

    You appear to have left out a lot. It appears from the sections quoted that not only where you deported you got caught trying to get back into the US illegally afterward? It's unlikely you'd get a hardship waiver after BOTH of those events. You'll need an immigration lawyer if you have a prayer.

    Yeah, paying the fee again is the least of your concerns.

    The information is NOT all there. You haven't indicated any of the events that led to your bar. Since you want to be obstinate, about it the answer to your question is:

    Yes you can apply for a waiver. You will be denied.
    You don't have to worry about the other stuff, because your VISA application won't be considered with the waiver in place.

    In 2021 you can apply fresh (yes starting over from the absolute beginning).
