My question involves collection proceedings in the State of: Alabama

We visited the ER on Xmas day 2012. A tornado had just hit the building so there was a little bit of chaos going on. My daughter was having asthma problems all day so we decided to take her to the ER to make sure her oxygen levels were not too low.

They did the oxygen test and her levels were fine. I was ready to take her home - that's the only thing we really needed checked - we had breathing treatments at home that helped. Then the ER doctor comes in and requests an xray - we questioned him but went ahead and allowed it. He comes back and says she has pneumonia and she needs to stay the night. We reluctantly agree.

Morning comes-she feels fine. We request to leave - they take FOREVER in deciding whether or not to allow it. In the meantime, the regular staff doctor comes in and tells us she does not have pneumonia.

At this point I know that she has been misdiagnosed and that this error has now cost me over $1000. Of course the bill comes in and I refuse to pay it. I tell them to separate the ER visit deductible and I will pay it ($250), the rest I refuse to pay. They persist in attempting to make us pay and do not separate the ER deductible.

Now I have a summons for small claims court in the amount of $1160.

My question is - is it worth it to fight? Do I have a chance to win under these circumstances? I believe the ER doctor was super busy and just shuffled us through the process - hurried and did not take his time to diagnose her properly. I do not feel as though I should pay for someone's mistake - especially $910...
