    Question Can a Teen Mom Get Emancipated In New Mexico

    My question involves juvenile law in the State of: New Mexico
    Ok so im 16 and have a baby.I want to get emancipated because my mom wount let me work or anything i live with my bf and i do still attened school but just online.When ever i need to go the doctors to get cheaked my mom dosent want to go.I need my ssc with me and my medicaid card with me if i go to the doctors office withou her but my mom dosent want to.I have to apply for healthcare for my baby but my mom has to apply for me but she dosent want too.She dosent want to help me get my baby healthcare and my baby gets sick alot

    You are not a candidate for emancipation.

    Aside from already having a child, which indicates a need for more supervision rather than less, you must ALREADY be completely self-supporting and have evidence that you have been for a while and will continue to be so.

    Emancipation is this:

    Think of the TV show "Party of Five". The parents are killed, the older brother wants to keep the family together. He needs to sign paperwork for his younger siblings.

    For you: I'm being blunt and honest and not giving you false hope.....

    Can you pay market rent on your own apartment? Bear in mind, you need to be making 3 times your rent amount...so $1800 per month.

    You need to be paying your own food. No food stamps. You need to be able to buy your own staples (toothpaste, toothbrush, floss, tampons, soap, deodorant, makeup, dishwashing soap, buy your own dishes and pots and pans, childcare needs).

    If that has not said "No, you don't qualify"....

    - Your a teen mom. You need more supervision, not less.
    - Can you pay for yours and your babies health insurance alone?
    - Do you have your own means of transportation?
    - Can you work a full time job and take care of your baby alone?

    If all the answers are No....my next step would be filing to collect child support from Baby Daddy, it took two to make him.

    Another piece of advice: Have mom look into plans for you with Planned Parenthood. They have a sliding scale fee for exams, birth control, etc. If your state has a program for low income people, PP will help you with it. And regarding birth control - since you are now a teen parent - I'd get onto something like Depo Provera (A shot every three months), and they offer free condoms. If you won't go abstinent, please consider those options.

    As soon as you said baby and Medicaid you shot any miniscule chance of emancipation out the window.
