    Default Contract for Repayment of Expenses with Employer

    Hi,

    My Current Employer, has sponserd me the visa from India to come and work here. I have signed a agreement saying that i will work for him for 18 months and if i leave them before that, he will be Eligible to claim Damages which includes H1b costs, accomodation and flight costs , marketing costs etc.
    He is asking for 8000$. Also He is Harrasing me too much from the time i have informed him that i would be moving. Now he wants a return ticket from me to show to his client that and sort out the Billing issues for them.

    I s it legal for him to claim what ever the amount that he says is loss for him just because i signed an agreement

    Kindly let me know your advice

    What did the agreement include? Why would you have to sign saying you had to work here 18 months, if there were not going to be any consequences of you leaving before then?

    Obviously, if you have not broken the contract you don't have to pay him anything. If he fires you he could be forced to pay your return transit himself, and I suspect he wants you to buy the ticket so he can do just that then fly you home on your own dime.

    Sir,

    This Contract might not be even binding in your jurisdiction. It could be illegal - you need to review it with an employment lawyer and an immigration attorney.
