    Default If Your Ex Stops Working Should She Still Have to Pay Child Support

    My question involves child support in the State of: California

    My ex was working while we were married, and then got fired. I purchased a small business where she was an employee and collected a small salary. I was making a substantial income as an executive. After the divorce, about a year ago, I chose to retire early and focus on my small business and other projects, taking a significant pay cut. She has not worked since working for my small business, about a year ago and remarried 6 months ago. Her new husband supports her and is extremely wealthy, meaning she will not ever have to work. I pay 100% of the child care and $1800 mo for our twin boys. My question is, can I revisit our arrangement based on her ability to earn even though she chooses not to earn?

    You can request the court impute her an income based on her choice not to work.

    How many years has it been since she worked? What level of education did she attain and if she had a degree, what was it in?

    You could only absolutely count on her getting imputed at 40 hours of minimum wage unless she has the education and fairly recent experience at a higher wage.

    Find an online calculator for CA and run the numbers with her imputed at minimum wage to see whether or not that would make a real distance.
