My question involves collection proceedings in the State of Wisconsin.
We filed for bankruptcy in 2009 and stayed in our home. At the tiime, the mortgage, and a second of $27,000, was owned by One West Bank. They discharged the second mortgage as a non collectable account but they did not remove the lien. Last year the mortgage was transferred to Ocwen. We have now sold the home and made a full payoff off the mortgage. The title company is holding our proceeds of $9,000 until we can clear the lien of the second mortgage, and give the buyer a clear title. We need to negotiate a settlement with One West Bank of the 2nd mortgage. They are requesting financials, including tax statements. I am reluctant to hand over personal information. I need to pay off medical bills ($5,600) and a car loan ($1,900) with these proceeds. Any advice on negotiating the settlement would be appreciated. Thank you.
